General Conditions GridArt
1. These conditions are a shortened version of our General Conditions in the Dutch language. In case of discrepancies, the Dutch conditions prevail.
2. These conditions rule the agreement between Gridart and its customers (the parties). Deviations to these conditions and to the agreement between the parties only apply when these are agreed between the parties in writing by email correspondence.
3. The agreement between the parties is for one year with silent annual renewals. Parties can terminate the agreement not later than three months before maturity of the agreement, otherwise a new year of Gridart service applies.
4. The price for the Gridart service is explained on the Gridart website and price changes which could occur from time to time are only applicable for the next service year.
5. Payment of the Gridart service should be made 14 days after invoice date. Invoices are sent electronically by email to the customer’s known email address. Collection costs including interest costs will become applicable when no payment is received by Gridart one month after the invoice date, and will be charged to the customer. When no payment is received after three months, Gridart has the right to stop its services to the customer and take the website off/from internet.
6. Gridart will do everything in its power to keep the customer’s website “in the air” (on internet) as much as possible, but technical and other problems or maintainance cannot be ruled out. When such interruptions in the Gridart service occur, Gridart cannot be held liable for business interruption costs. The customer cannot claim loss of income or opportunity losses. Gridart will inform the customer as quickly as possible about the new situation and continue communication about the status of the situation with the customer until the problems are solved.
7. The customer is not allowed to place text or images on its website which conflict with the generally accepted principles of good behaviour/conduct. The text of this article is intentionally left very general, because the “gray area” is too difficult to define. Because Gridart values its reputation as a “good citizen” highly, it is up to the management of Gridart to decide what is acceptable and what is not. The customer agrees when starting its business relationship with Gridart, that Gridart is authorized to edit or delete such texts and/or images at its discretion.
8. Dutch law applies and if needed, legal issues will be submitted to the district Court of Amsterdam.
